These Terms of Use (“Terms”) govern your access to and use of mobile applications, websites, software, features, subscriptions, purchases, and related services provided by Nistic (“Nistic,” “we,” “us,” or “our”).

By downloading, accessing, purchasing, subscribing to, or using any Nistic application or service, you agree to these Terms. If you do not agree, do not use our applications or services.

2. Applications and Services

Nistic develops and provides mobile applications and related digital services. These may include, but are not limited to, productivity tools, tracking tools, calculators, document tools, financial tracking utilities, business utilities, and other mobile software.

The specific features available may vary by application, device, operating system, region, subscription status, and app version.

We may update, modify, add, remove, suspend, or discontinue features at any time.

3. License to Use Our Apps

Subject to your compliance with these Terms, Nistic grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use our applications for your own personal or internal business use.

You may not:

  • copy, modify, reverse engineer, decompile, or attempt to extract source code from our apps;

  • sell, rent, lease, sublicense, distribute, or commercially exploit our apps without permission;

  • use our apps for unlawful, harmful, fraudulent, abusive, or unauthorized purposes;

  • interfere with or disrupt the operation of our apps or services;

  • attempt to bypass subscriptions, purchases, access controls, or technical restrictions.

For apps downloaded through Apple’s App Store, your use may also be subject to Apple’s standard Licensed Application End User License Agreement and Apple Media Services terms, unless a separate custom EULA applies. Apple’s standard EULA explains the scope of the app license and related App Store terms.

4. Accounts and Device Access

Some apps may require access through your Apple ID, Google account, app store account, email address, or another account system.

You are responsible for:

  • maintaining the security of your device and accounts;

  • keeping your login credentials confidential;

  • all activity that occurs through your device or account;

  • ensuring that your use of the app complies with applicable laws.

We are not responsible for losses caused by unauthorized access to your device, app store account, or user account.

5. Subscriptions, Trials, and Purchases

Some Nistic apps may offer paid features through subscriptions, free trials, one-time purchases, lifetime purchases, consumable purchases, or other in-app purchases.

5.1 Subscriptions

Subscriptions may automatically renew unless canceled before the end of the current billing period. Billing, renewal, cancellation, and refund handling are managed by the app store or payment provider through which you purchased the subscription.

For Apple App Store purchases, you can manage or cancel subscriptions through your Apple ID subscription settings.

5.2 Free Trials

Some subscriptions may include a free trial. Trial availability may depend on your app store account, region, previous trial usage, and the rules of the applicable app store.

If a free trial is offered, you may be charged automatically when the trial ends unless you cancel before the trial expires.

5.3 Lifetime Purchases

A “lifetime” purchase means access to the purchased app features for the lifetime of that app or service, as made available by Nistic. It does not guarantee that the app or service will be available forever, across all platforms, or under all future business or technical conditions.

5.4 Pricing Changes

We may change prices at any time. Price changes for existing subscriptions are handled according to the rules of the app store or payment provider.

5.5 Refunds

Refunds are handled by the app store or payment provider through which the purchase was made. Nistic does not control app store refund decisions.

6. User Content and Data

Some apps may allow you to enter, create, store, upload, generate, scan, import, or export information, files, images, documents, notes, financial records, work records, shift records, tips, receipts, or other content (“User Content”).

You retain ownership of your User Content.

You are responsible for:

  • the accuracy of the information you enter;

  • backing up important data where appropriate;

  • ensuring that your User Content is lawful;

  • ensuring that you have the right to use, upload, or process any content you provide.

Nistic is not responsible for incorrect data entered by you, lost data, deleted data, unavailable backups, device failure, app store issues, or operating system issues.

Where an app stores data locally on your device, deleting the app may delete your data unless the app specifically supports backup, sync, or export.

7. No Professional Advice

Nistic apps may help you track, organize, calculate, estimate, or generate information. However, our apps do not provide legal, financial, tax, accounting, employment, medical, or other professional advice.

You are responsible for verifying any calculations, documents, records, reports, exports, or app-generated information before relying on them.

For legal, tax, financial, or business decisions, consult a qualified professional.

8. Acceptable Use

You agree not to use our apps or services to:

  • violate any law or regulation;

  • infringe the rights of others;

  • create, store, transmit, or distribute unlawful, harmful, abusive, misleading, or fraudulent content;

  • attempt to gain unauthorized access to systems, accounts, or data;

  • interfere with the security or operation of our apps;

  • abuse refunds, trials, subscriptions, or app store systems;

  • use the app in a way that could damage Nistic, other users, or third parties.

9. Third-Party Services

Our apps may interact with third-party services, including but not limited to:

  • Apple App Store;

  • Google Play;

  • payment processors;

  • analytics providers;

  • cloud services;

  • email services;

  • document generation tools;

  • AI or automation services;

  • operating system features.

Your use of third-party services may be governed by their own terms and privacy policies. Nistic is not responsible for third-party services, outages, errors, fees, policies, or decisions.

10. Availability and Updates

We aim to keep our apps useful and reliable, but we do not guarantee that any app or service will be available at all times, uninterrupted, secure, or error-free.

We may release updates, bug fixes, design changes, feature changes, pricing changes, or compatibility updates.

Some features may stop working if:

  • your device or operating system is unsupported;

  • an app store or third-party service changes;

  • required permissions are disabled;

  • the app is outdated;

  • internet access is unavailable;

  • the app or service is discontinued.

11. Beta Testing and TestFlight

If you use a beta version of an app, including through TestFlight or another testing platform, you understand that beta software may contain bugs, incomplete features, crashes, data loss issues, or design changes.

Beta versions are provided for testing and feedback and may change before public release.

12. Intellectual Property

All apps, designs, logos, icons, names, text, graphics, code, features, layouts, animations, and other materials provided by Nistic are owned by Nistic or its licensors and are protected by applicable intellectual property laws.

You may not use Nistic’s branding, logos, app names, screenshots, or other materials without permission, except where allowed by law or app store rules.

13. Privacy

Your use of our apps is also governed by our Privacy Policy, available at:

If an individual app has a separate privacy policy or additional disclosures, those terms may also apply.

14. Disclaimer of Warranties

To the maximum extent permitted by law, our apps and services are provided “as is” and “as available.”

Nistic makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, or that the app will be error-free or uninterrupted.

You use our apps at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, Nistic shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • loss of profits;

  • loss of revenue;

  • loss of data;

  • business interruption;

  • device issues;

  • incorrect calculations;

  • missed payments;

  • tax, financial, legal, or employment consequences;

  • reliance on app-generated information;

  • inability to access or use the app.

To the maximum extent permitted by law, Nistic’s total liability for any claim related to an app or service shall not exceed the amount you paid to Nistic for that app or service during the twelve months before the claim arose.

16. Indemnification

You agree to defend, indemnify, and hold harmless Nistic from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • your use of our apps;

  • your User Content;

  • your violation of these Terms;

  • your violation of any law or third-party rights;

  • your misuse of subscriptions, purchases, exports, reports, documents, or app-generated information.

17. Termination

We may suspend or terminate your access to any app or service if you violate these Terms, misuse the app, create risk for Nistic or others, or if we discontinue the app or service.

You may stop using our apps at any time.

Upon termination, your right to use the app or service ends. Certain sections of these Terms will continue to apply, including sections related to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app, website, app store listing, or another reasonable method.

Your continued use of our apps after changes become effective means you accept the updated Terms.

19. Governing Law

These Terms shall be governed by the laws of the State of Idaho, United States, without regard to conflict of law principles.
