Terms of Use for Shiftly
Effective date: April 17, 2026
These Terms of Use (“Terms”) govern your use of the Shiftly mobile application, related content, and related pages on nistic.net. Shiftly is provided by Nistic, a U.S. sole proprietorship (“Nistic,” “we,” “us,” or “our”).
By downloading, accessing, or using Shiftly, you agree to these Terms.
1. Eligibility
You must be legally capable of agreeing to these Terms in your jurisdiction to use Shiftly.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Shiftly for your personal or internal business use on devices you own or control, in accordance with Apple’s platform rules.
3. The service
Shiftly is a shift-tracking and scheduling utility. Features may include shift logging, scheduling, overtime calculations, exports, reminders, and premium subscription features.
We may modify, improve, suspend, or discontinue parts of the app from time to time.
4. Subscriptions and paid features
Some Shiftly features may require a paid subscription.
If you purchase an auto-renewable subscription through Apple:
payment will be charged to your Apple account
subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
your account will be charged for renewal within 24 hours before the end of the current billing period
you can manage or cancel subscriptions through your Apple ID account settings after purchase
If a free trial is offered:
you may be charged automatically when the trial ends unless you cancel before the end of the trial period
deleting the app does not automatically cancel your subscription
Pricing may change in the future to the extent permitted by Apple and applicable law.
5. Refunds
Purchases, cancellations, and refunds for in-app subscriptions are generally handled by Apple under Apple’s policies. If you need billing or refund assistance, please use Apple’s support channels first.
6. User data and responsibility
You are responsible for the accuracy of the information you enter into Shiftly, including shift times, rates, currencies, locations, and notes.
Shiftly is a productivity tool and not a substitute for legal, payroll, tax, accounting, or employment advice. You are responsible for reviewing and confirming any records, exports, calculations, or reports before relying on them for payroll, accounting, tax, or compliance purposes.
7. Acceptable use
You agree not to:
misuse the app
interfere with app operation or security
attempt to reverse engineer the app except where prohibited by law from restricting that activity
use the app in a way that violates applicable law or the rights of others
8. Exports and calculations
Shiftly may generate exports such as CSV, spreadsheet, or PDF output and may calculate hours, pay, overtime, or grouped totals based on the data you provide. These outputs are tools for convenience only. You should independently review exported records and calculations before relying on them.
9. Privacy
Your use of Shiftly is also governed by the Shiftly Privacy Policy available at:

10. Intellectual property
Shiftly and its associated content, branding, design, software, and documentation are owned by Nistic or its licensors and protected by applicable intellectual property laws.
11. Disclaimers
Shiftly is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee that the app will be uninterrupted, error-free, or suitable for every purpose.
12. Limitation of liability
To the fullest extent permitted by law, Nistic will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or other intangible losses arising out of or related to your use of Shiftly.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Shiftly will not exceed the amount you paid to us, if any, for Shiftly in the 12 months before the event giving rise to the claim.
13. Indemnity
You agree to indemnify and hold harmless Nistic from claims, liabilities, damages, losses, and expenses arising out of your misuse of Shiftly, your violation of these Terms, or your violation of applicable law or the rights of another party.
14. Termination
We may suspend or terminate access to Shiftly if you violate these Terms or if we need to protect the app, users, or our rights.
15. Governing law
These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law principles, except to the extent superseded by applicable consumer protection law.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice.
